These Terms of Service (“Terms”) form a binding agreement between you (“you”, “customer”) and MomentSong (“MomentSong”, “we”, “us”). By placing an order on moment-songs.com or any associated MomentSong site, you agree to these Terms, our Privacy Policy, and our Cancellation Policy. If you do not agree, please do not use the service.
You confirm that you are at least 18 years old (or the legal age of majority in your jurisdiction) and that the information you provide is accurate.
MomentSong is a custom-song production service. After you submit your story and verify your email, we collect a one-time song-production fee. Our songwriters and producers then write, record, mix, master, and deliver a custom song based on the details you provide.
We may use a combination of professional musicians, producers, lyricists, and AI-assisted production tools to create your song. By placing an order you accept this hybrid production approach as part of the MomentSong service.
The current production fee is displayed on the checkout page in U.S. Dollars and is processed by our payment provider, Stripe. Promotional pages may show a comparison price and a first-time customer discount; the amount shown at Stripe checkout is the amount you authorize us to charge, plus any applicable taxes. The fee is due in full at checkout and must clear before production begins.
We do not store full payment-card information on our servers. All card data is handled by Stripe under PCI-DSS compliance.
Prices, promotions, and discount codes may change at any time. The price you see at the moment you complete checkout is the price you pay for that order.
We aim to deliver every MomentSong within 24 hours of payment, but timing is a target rather than a guarantee. Production speed can vary with creative complexity, queue depth, and creator availability. We will keep you informed by email if your delivery is taking longer than expected.
If the delivered song materially misses the brief you submitted, you may request one remake review by emailing hello@moment-songs.com within 14 days of delivery. Remake support is intended to correct missed details, wrong tone, unusable pronunciation, or a clear mismatch with the chosen direction. It is not a way to request an unrelated new concept after production is complete.
Additional remakes, substantial changes to the original story, or fundamentally new song concepts may require a new order.
Because production starts as soon as payment clears, cancellation and refund eligibility are limited and follow the rules in our Cancellation Policy. Please review it before placing an order.
You retain ownership of the personal stories, names, photos, and other materials you submit (“Customer Content”). By submitting Customer Content you grant MomentSong a worldwide, royalty-free license to use it solely to produce, deliver, and store your MomentSong, and to operate and improve our service.
You agree not to submit content that:
We reserve the right to refuse, edit, or remove any order or content that violates these Terms, and to issue a full or partial refund at our discretion when an order is rejected for content reasons.
MomentSong (and its contributing creators) retains the underlying copyright in the musical composition and master recording of the song we deliver to you. You receive a perpetual, worldwide, non-exclusive, royalty-free license to use the delivered MomentSong for personal, non-commercial purposes, including:
You may not resell, sublicense, monetize, or commercially exploit the song (for example by uploading it to streaming services for revenue, syncing it in paid advertising, or licensing it to third parties) without our prior written consent.
We may use anonymized excerpts, lyrics, or production samples from your song to demonstrate the MomentSong service, unless you explicitly opt out by writing to hello@moment-songs.com.
All MomentSong trademarks, logos, site content, software, and the layout of moment-songs.com are owned by MomentSong or its licensors and are protected by copyright, trademark, and other intellectual-property laws. You may not copy, modify, or distribute our materials without prior written permission.
The service and any delivered song are provided on an “as is” basis. To the fullest extent permitted by law, MomentSong disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, MomentSong's total liability for any claim arising out of or relating to the service or a delivered song is limited to the amount you paid for that order. We are not liable for indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility of such damages.
You agree to defend, indemnify, and hold harmless MomentSong and its team from any claim arising from Customer Content you submit, your use of the delivered song outside the license granted in Section 7, or your breach of these Terms.
We may update these Terms from time to time. The version that applies to a given order is the version in effect at the time you place that order. We will post the “Last updated” date at the top of this page when changes are made.
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Any dispute that cannot be resolved informally will be resolved by binding arbitration in Delaware on an individual (non-class) basis, except that either party may seek injunctive relief in a court of competent jurisdiction to protect its intellectual-property rights.
